The Supreme Court today upheld a High Court order that stayed the Election Commission’s decision allowing BNP candidate Afroza Khan Rita to contest the election for Manikganj-3 constituency.
Afroza Khan cannot contest the December 30 election following the apex court order, Deputy Attorney General Motaher Hossain Sazu told The Daily Star.
A seven-member bench of the Appellate Division of the SC headed by Chief Justice Syed Mahmud Hossain passed “no order” on a petition filed by Afroza Khan seeking a stay on the HC order.
Earlier on December 12, the HC bench of Justice JBM Hassan and Justice Md Khairul Alam stayed the EC’s decision that allowed Afroza Khan to contest the election.
It passed the order following a writ petition filed by Sonali Bank claiming that Afroza is a defaulter of Tk 1,800 crore from the bank, DAG Sazu said.
Advocate Dr Kazi Akhter Hamid appeared for Sonali Bank, while Barrister Ajmalul Hossain argued for Afroza.
