The High Court today cleared the way for Awami League candidate for Dhaka-17 constituency, Akbar Hossain Pathan Farooque, also a film actor to run for the December 30 elections.
The court rejected a petition filed by Bangladesh Jatiya Party candidate Andalib Rahman Partha challenging the Election Commission's decision allowing Farooque to contest the election saying that Farooque is a bank loan defaulter.
The High Court bench of Justice JBM Hassan and Justice Md Khairul Alam rejected the petition considering the fact that the petition was not moved properly as Partha did not move any appeal before the Election Commission challenging Farooque’s candidacy.
There is no legal bar for Farooque to contest the polls race following the High Court order.
Earlier on December 24, Partha filed a writ petition with the High Court challenging the candidacy of Farooque saying, Farooque Dying and Manufacturing Ltd, owned by Farooque is a defaulter of more than Tk 5,000 core from Sonali Bank, and therefore he is not eligible to contest the election.
