2 HC benches refuse to hear writ on Rifat murder

Two separate High Court benches today refused to hear a writ petition that sought its directive on the law enforcers to arrest in 24 hours all the accused in a case filed over the murder of Rifat Sharif in Barguna.

Supreme Court lawyer Eunus Ali Akond submitted the petition as public interest litigation this morning also seeking its order on the government to issue red alert against the accused and to ensure security of the people of whole country. 

The bench of Justice Moyeenul Islam Chowdhury and Justice Md Ashraful Kamal declined to hear the petition saying that the law enforcers have reportedly arrested some of the accused and are trying to arrest the others, Advocate Eunus Ali Akond told The Daily Star.  

He said another HC bench of Justice of Justice Sheikh Hassan Arif and Justice Razik-Al-Jalil also refrained from hearing the same petition and advised Eunus Ali to move the petition before another bench.

Eunus Ali Akond further said he would move the petition before another HC bench today for necessary orders.

Citing the petition, Advocate Eunus Ali said the respondents are liable to ensure the security of all the citizens of the country including the Rifat Sharif as per the constitution, but it has failed to discharge the duties.

He prayed to the HC to issue a rule asking the respondents to show cause why their inaction to the ensure the right to life of the citizens should not be declared illegal.

Secretaries to the home and law, inspector general of police, director general of Rapid Action Battalion and Border Guard Bangladesh, deputy commissioner and superintendent of police of Barguna and officer in charge of Barguna Police Station have been made respondents to the prayed rule, Eunus Ali added.
