Narail judge apologises to HC for exempting prime accused
District and Sessions Judge of Narail Sheikh Abdul Ahad has unconditionally apologised to the High Court for exempting the principal accused of a murder case.
“I offer unconditional apology for the mistake and I will remain careful so as not to repeat the same mistake in the future,” Judge Abdul Ahad said in an application submitted to the High Court today.
He sent the written apology to the Supreme Court registrar general’s office on July 10.
The attorney general’s office today placed the copy before the High Court bench of Justice M Enayetur Rahim and Md Mostafizur Rahman as per its July 7 order.
The High Court bench fixed August 20 for passing further order on this issue.
On July 7, the court ordered the judge to explain why his judicial powers should not be curtailed for exempting the main accused of a sensational murder case.
Assistant Attorney General (AAG) Md Yousuf Mahmud Morshed told The Daily Star that one Enamul Haque was shot dead at Barnail Bazar area under Kalia Police Station in Narail on February 10, 2015.
The following day, Enamul’s brother Nazmul Huda filed a case with Kalia Police Station against 68 persons including a Mallick Mazharul Islam alias Maza.
In the case statement, he said Mallick ensured the death of his brother Enamul by firing three bullets into his body.
The judge on June 10 this year indicted in the case dropping the name of Mallick from the charge sheet.
Nazmul recently filed a petition with the HC challenging the district judge’s order, where he prayed to the HC to order the trial court judge to include Mallick in the case, AAG Morshed said.
