The Supreme Court today asked the BSMMU authorities to form a new board to examine the health of BNP acting secretary general Mirza Fakhrul Islam Alamgir and submit a report before it on July 12.
The five-member board of the Bangabandhu Sheikh Mujib Medical University (BSMMU) will have to submit the report by 3:00pm on that day.
A four-member bench of the Appellate Division also fixed July 13 for passing an order on the government petition against the High Court order that had granted bail to Fakhrul in three separate vandalism and arson cases.
The apex court ordered to form the fresh medical board as Fakhrul’s lawyers raised question over the report submitted yesterday by a four-member medical board of BSMMU in compliance with the SC’s July 5 order.
Khandaker Mahbub Hossain, a lawyer of Fakhrul, told the court that the BSMMU submitted the medical report, saying his is suffering from neck pain, where as, the BNP leader has been suffering mainly from cardiovascular problem.
Advocate Sagir Hossain Lion, another counsel for Fakhrul, told The Daily Star that his client would not get released until the apex court grants him bail in the cases.
The pleas were enlisted in today's cause list of the bench headed by Chief Justice Surendra Kumar Sinha, as the medical report of Fakhrul reached the apex court yesterday afternoon.
The Appellate Division was scheduled yesterday to pass an order on the three petitions. But it didn't pass the order because of not getting the report by then.
On June 21, the HC gave bail to Fakhrul in the three cases filed with Paltan Police Station on January 4, 5 and 7 under the Explosive Substances Act.
Later, the government filed the three petitions with the SC seeking stay on the HC orders.
