I’m shocked at restoration of SJC: AG
Attorney General Mahbubey Alam today expressed sorrow at the restoration of Supreme Judicial Council (SJC) through the Supreme Court judgment in the constitution’s 16th amendment case.
“I am shocked at the restoration of the Supreme Judicial Council, as this system had been introduced by the military rulers,” he said while expressing reaction to media at his office in the SC premises about the release of full text of apex court verdict in the 16th amendment case.
Replying to a question, the attorney general said the government will take the decision whether it will move a petition before the SC seeking review of its verdict that upheld the High Court judgement scrapping the 16th amendment which had empowered the parliament to remove its judges for incapacity or misbehaviour.
He refused to make any comment on whether the parliament has to formulate a law for making the Supreme Judicial Council effective.
He, however, questioned the necessity of parliament if everything is restored by the court.
Article 116 of the constitution regarding the president’s power to control discipline of lower court judges was not the issue in the 16th amendment case, the attorney general said.
