The Supreme Court is set to pass an order on Wednesday on the appeal filed by convicted war criminal and Jamaat-e-Islami leader Abdus Subhan challenging his death penalty.

The apex court has included the appeal in its cause [proceeding] list for an order, according the cause list uploaded in the SC website.   

The three-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha on Wednesday may ask the state and defence counsels to submit concise statements on the appeal and may fix a date for its hearing, Assistant Attorney General Bashir Ahmed told The Daily Star.

A concise statement contains the points on which the lawyers place arguments before the court.

On August 13, the apex court fixed October 10 for hearing the appeals filed by convicted war criminals Jamaat-e-Islami leader ATM Azharul Islam and Jatiya Party leader Syed Mohammad Qaisar challenging their death penalty awarded to them by the International Crimes Tribunals. 

Jamaat leader Abdus Subhan on March 18, 2015 filed an appeal with the SC challenging his death penalty awarded by a war crimes tribunal for committing crimes against humanity during the Liberation War.

In his appeal filed with the Supreme Court, Subhan pleaded not guilty and sought his acquittal of all the six charges, in which he was found guilty.

On February 18, 2015, Jamaat Nayeb-e-Ameer Subhan, who led the anti-liberation elements in Pabna in 1971, was sentenced to death on three charges, imprisonment until death on two charges and five years' imprisonment on another by the International Crimes Tribunal-2.
