ACC commissioners to stay free of chairman’s control

The Supreme Court today upheld a High Court verdict that scrapped the provision of the Anti-Corruption Commission (ACC) law which tied its commissioners under the control and supervision of its chairman.

The Appellate Division passed a “no-order” on a petition filed by ACC chairman M Bodiuzzaman seeking stay on the HC verdict.

A four-member bench of the apex court headed by Chief Justice Surendra Kumar Sinha however said the ACC Chairman can move a leave-to-appeal petition before the SC against the HC judgment.

ACC chairman’s lawyer Khurshid Alam Khan told the Daily Star that his client will file a leave-to- appeal petition with the SC challenging the HC verdict.

He said the HC judgment will remain in force until the SC passes further order on the issue.

On November 19, the HC scrapped a provision of the ACC Act 2004, which the court said curtailed the independence of the commissioners.
