HC stays Rajuk’s notice to relocate a Gulshan restaurant
The High Court today stayed for six months the effectiveness of a notice issued by Rajdhani Unnayan Kartripakkha (Rajuk) that asked the authorities to relocate Food Palace Restaurant from Gulshan-1.
The court, however, ordered the owner of the restaurant to relocate it from Gulshan-1 by January 10, next year.
The court also issued a rule asking Rajuk and the government to explain within four weeks as to why the Rajuk's notice should not be declared illegal, Deputy Attorney General Mokhlesur Rahman told The Daily Star.
Rajuk, on July 11, issued the notice to the authorities concerned of Food Palace Restaurant to remove the structure by January 19, 2017.
The Rajuk also said in the notice that it will evict the restaurant if the owner fails to do so.
Restaurant's Managing Director Abdullah-Al-Harun on Sunday filed a writ petition with the HC challenging the legality of Rajuk's notice.
After holding a hearing on the petition the HC bench of Justice Quamrul Islam Siddique and Justice Razik-Al-Jalil passed the order and issued the rule today.
