Road crash victim’s family wins compensation
A Dhaka court today ordered the Rupali Bank to pay Tk 6 lakh as compensation to the family of a rickshaw-puller killed in a road crash.
Mohammad Niazuddin was injured when a staff bus of the state-run bank hit him at Motijheel in 1996.
This is a second such judgment in which a Dhaka court directed the defendants to pay compensation for the death in road accidents.
Judge Utpal Bhattacharjee of the Second Joint District Judge’s Court passed the order following a damage case claiming Tk 6 lakh in compensation for the death of Mohammad Niazuddin.
The court directed the bank to pay the sum by the next 90 days. In default, the plaintiff will realise the money through legal process with the court’s permission.
Niazuddin was injured when a Rupali Bank staff bus hit him in front of Modhumita Cinema Hall at Dhaka’s Motijheel area about 4:30pm on February 12, 1996 when he was pulling his rickshaw with passengers.
After a long battle for life, he succumbed to his injuries on September 22, 2009.
Following the incident, Niazuddin on August 26, 1996 filed the compensation case against three people including the managing director and driver of the bank claiming Tk 6 as compensation.
Before filing the case, Niazuddin served legal notices twice through his lawyer asking the bank to pay compensation for the damage but the bank did not give any reply.
On March 20, 2005, another Dhaka court ordered Bangladesh Beverage Industries Limited to pay Tk 3.52 crore as compensation to the family of deceased Mozammel Hossain Montu, former news editor of the Daily Sangbad.
Montu was injured when a mini truck of the company hit him at Kakrail in Dhaka on December 3, 1989. He succumbed to his injuries on December 16 the same year while undergoing treatment.
