HC judge ‘embarrassed’ to hear writ challenging appointments of DAGs, AAGs
One judge of a High Court bench today said he felt "embarrassed" to hear a writ petition challenging legality of appointments of deputy attorney generals (DAGs) and assistant attorney generals (AAGs) in 2019.
The bench of Justice Farah Mahbub and Justice SM Maniruzzaman also dropped the petition from hearing list and asked the petitioner to place it before the chief justice for a decision.
Justice Farah Mahbub said Justice SM Maniruzzaman felt embarrassed to hear on the petition as he was a DAG and the respondents (DAGs AAGs) were his colleagues in the past and they are still in touch now.
Writ petitioner Farhad Uddin Ahmed Bhuiyan told The Daily Star that he will now place his petition before Chief Justice Syed Mahmud Hossain.
The chief justice may assign another HC bench for hearing the petition, he said.
On September 8, 2019, Farhad Uddin, also a lawyer, filed the writ petition with the HC challenging legality of appointments of 70 DAGs and 105 AAGs in July 2019.
He claimed in the petition that few of the DAGs have no experience of practicing law for at least 10 years and some of the AAGs also have no experience of practicing law for at least five years before the Appellate and HC Divisions of the Supreme Court.
Following the petition, a HC bench on November 12, 2019 issued a rule questioning the appointment of two DAGs and an AAG, Farhad said, adding that neither the government nor the DAGs and AAG have yet to make any reply to the rule.
