Oath-taking of 290 MPs: Appellate Division adjourns hearing on appeal till Sunday

The Supreme Court today adjourned till Sunday the hearing of a four-year-old appeal that challenged the legality of taking oath by 290 lawmakers of the Awami League (AL)-led grand alliance.
A full bench of the Appellate Division of the SC headed by Chief Justice Hasan Foez Siddique passed the adjournment order following a time prayer moved by the petitioner's lawyer AM Mahbub Uddin Khokon.
The 290 lawmakers were elected in the polls held on December 30, 2018.
SC lawyer Taherul Islam Tawhid filed the leave to appeal petition with the SC on August 20, 2019 against the High Court order that on February 18, 2019 summarily rejected his writ petition which challenged the legality of the oath taking of the lawmakers on January 3, 2019.
Lawyer Mahbub Uddin Khokon told The Daily Star that oath taking by the 290 lawmakers was "unconstitutional" as the tenure of the 10th parliament expired on January 28, 2019.
Therefore, there were two parliaments from January 3 to January 28 in 2019 -- which is unconstitutional, he said, adding that the BNP lawmakers had taken oath much later.
Additional Attorney General SK Md Morshed represented the state during yesterday's hearing.
